A personal injury case can arise when another persons negligence causes you, or a loved one, to suffer physical injury. While personal injury cases can occur in a multitude of ways, car accidents are the leading cause of personal injury cases in the United States. Alaska is no exception to the rule. Our slippery roads and icy conditions can make the perfect setting for a car accident. A serious car accident can cause many years of suffering and medical care. If you, or a loved one, has been injured because of another persons negligence, then you may have a personal injury claim. In Alaska, you have 2 years to assert such a claim, so do not wait to seek out legal counsel. NEVER cash or deposit a check from the insurance company prior to speaking with a Fairbanks attorney. A wrongful death claim occurs when someone is responsible for an accident, and the accident results in the death of another. As long as the individual killed in the accident was not responsible in any way, it is "wrongful death" and could allow surviving family members to file a claim. At Fulk Law Office, we know that there is no way to replace a loved one. No judgment in court, and no amount of money can make up for that loss. However, it can help alleviate the stress by providing just compensation during your time of grief. We will counsel and guide you through this process, providing compassion and support for you while aggressively pursuing your claim. Contact Fulk Law Office for a FREE wrongful death consultation.

Child custody can be one of the most emotionally charged areas of the law. As a parent, you are expected to put your personal animosity aside, and cooperate with the other parent for the well-being of your child. Even though you and the other parent have separated and may have a strained personal relationship, you will be expected to co-parent in a manner which promotes the best interests of your child. This can be difficult to do, and it requires a mature attitude from both sides. A competent attorney is critical when you are navigating through a child custody proceeding. Child support is the financial support paid from one parent to the other parent to help with the costs of raising the child. Typically, child support is paid by the non-custodial parent to the custodial parent. However, in some circumstances, even parents that share custody equally may require one parent to pay the other parent support if there is a disparity in income. That determination is made under Alaska Civil Rule 90.3. Child support is not calculated by your taxable or Adjusted Gross Income (AGI). For purposes of determining child support, actual income is used, which is much broader and different from taxable income or AGI. Actual income can include wages, salaries and tips, commissions, bonuses, earnings, profits and dividends, severance pay, pensions, and Alaska PFD's. We can help you, either, negotiate a workable child support payment amount, or simply assist you in determining the correct statutory calculation. Contact Fulk Law Office for a consultation.

Preparing for the future seems to be a fairly straight forward concept. Most of us want to prepare for the future, but far too many of us put off our estate planning until it is too late. We all work hard for our money and assets, and we are careful to make sure our family is provided for. Yet, time and time again families turn on one another to fight over the children and/or assets of a loved one who died unexpectedly, and left no will. Do not put your family in that position. A simple will is imperative for any estate plan and everyone should have a will on file with the court. Contact Fulk Law Office to schedule a consultation.
Many people do not even know what the word "probate" means. Simply put, probate is the legal term that describes the process that takes place after someone dies. It can include proving that the will is valid, documenting and creating an inventory of a deceased person's property, having the property of a deceased person's property, paying debts, taxes, etc., and distributing the property as the will directs. Probate usually involves paperwork and court appearances. Attorney fees and court fees are paid from the estate funds, if there are any. The Personal Representative in the will takes on this job and hires the attorney to assist in the process. Probate usually takes a minimum of six months and can take up to a year or more on some occasions. Contact Fulk Law Office to schedule a consultation.

An order of protection is also commonly referred to as a "Restraining Order" or Domestic Violence Protective Order (DVPO), which essentially restrains or prevents one person from making contact with another person. You can file for a protective order if you are in "reasonable apprehension of bodily harm" from your partner or family member. You can also file for an order if you are the victim of a crime of domestic violence. To file for a protective order, you will begin with what is called an "ex parte" order, or a short-term 20 day protective order. You will tell the judge why you need the order to be put in place and if the judge finds it to be necessary, he or she will enter a short-term 20 day order. At that time, the other person is served with the order and is given a hearing date. At that hearing, you will put on your evidence and the other person will be on his or her evidence. If the judge finds that a crime of domestic violence has occurred, the judge will enter a 1 year long-term protective order. There are serious consequences to having one of these orders entered against you. For example, you will be prohibited from owning or possessing a firearm.
